1. Agreement
By downloading or using Tripwire (the "App") you agree to these Terms. If you do not agree, do not use the App.
2. What the App is
Tripwire uses your device's camera to detect movement in front of it, alerts you locally when it does, and saves photographs and a short audio/video clip of the event on your device. All processing and all storage happens on your device.
3. What the App is not
Tripwire is not a security system. It is not an alarm service, a monitoring service, or an emergency response service. It does not contact law enforcement, a security provider, a monitoring center, or any other person or organization on your behalf, and it has no capability to do so.
Tripwire is not reliable enough to be depended on for safety. It can fail to detect movement. It can alert when nothing significant occurred. Its accuracy depends on lighting, camera placement, distance, and the nature of the movement.
Tripwire only works in the foreground. The App must be open and visible, the device must remain still, and the device should remain powered. It stops detecting when the App is backgrounded, when the screen is locked, when a call arrives, or when the device is moved, runs out of battery, or overheats.
Do not use Tripwire where failure could cause harm, including monitoring children, monitoring people who need medical or physical supervision, protecting against violent crime, or any circumstance where you would be relying on it for someone's safety.
4. Acceptable use
You agree not to use the App:
- to record, monitor, or observe any person without the legal right to do so;
- in any location where monitoring would violate a person's legal privacy rights;
- for stalking, harassment, or surveillance of another person;
- covertly, or in a manner designed to conceal that monitoring is occurring;
- in violation of any applicable law or regulation.
Laws governing recording and monitoring differ by jurisdiction and by circumstance. Determining what is lawful where you are is your responsibility, not ours.
5. Your device and your data
The App processes camera frames on your device. When movement trips the wire it saves photographs and a short audio/video clip inside the App on your device, subject to a storage budget that deletes the oldest unpinned events automatically. It sends nothing to us or to any third party. We therefore hold no data about your use of the App and can neither retrieve nor delete anything for you; deleting the App deletes all events. Recordings you export through the share sheet are your responsibility from that point. See the Tripwire Privacy Policy.
Audio recording. If you grant microphone access, event clips include audio. Many jurisdictions require the consent of every party to an audio recording. Granting the permission does not make a recording lawful; that determination is yours (Section 4).
6. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for personal, non-commercial purposes, subject to these Terms and to Apple's standard license terms for App Store applications.
You may not copy, modify, reverse engineer, decompile, redistribute, rent, lease, or sell the App, except where such restriction is prohibited by applicable law.
7. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL DETECT ANY PARTICULAR EVENT, THAT IT WILL OPERATE WITHOUT INTERRUPTION OR ERROR, OR THAT ITS ALERTS WILL BE TIMELY, ACCURATE, OR RECEIVED.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOMEDON TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, PROPERTY, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING ANY LOSS, THEFT, DAMAGE, INJURY, OR OTHER HARM THAT THE APP FAILED TO DETECT, FAILED TO ALERT YOU TO, OR ALERTED YOU TO INACCURATELY.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities, so some of the above may not apply to you.
9. Payment
[Pricing model not yet decided. If a one-time unlock: state the price, that it is a one-time purchase, and what it unlocks. If tiered or subscription: state each tier and its features and the renewal terms. Purchases are processed by Apple; refunds are handled by Apple under its own policies, not by us.]
10. Changes to the App and these Terms
We may change, suspend, or discontinue the App or any of its features at any time. We may update these Terms; the effective date above will change and continued use after that date constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws principles. [Counsel to confirm venue and any dispute-resolution provisions.]
