1. Agreement
These Terms of Use govern your use of automedon-tech.com and the pages under it (the "Site"), operated by Automedon Technologies LLC, a Virginia limited liability company ("Automedon", "we", "us"). By using the Site you agree to these Terms. If you do not agree, do not use the Site. Products with their own terms, such as the Tripwire app, say so on their own pages, and those terms govern the product.
2. What the Site is for
The Site describes Automedon's products, services, and research and lets you ask us about them. Nothing on the Site is an offer to sell, a warranty, a quotation, or advice. Descriptions of capabilities are general and may describe features that are in development, in limited release, or available only to certain customers.
3. Requests for access
Some capabilities described on the Site are available only to authorized United States government customers and to commercial organizations we have vetted. Submitting a request through the Site does not create any right of access. We may decline any request for any lawful reason and may ask for additional information about your organization before responding.
4. Export control and sanctions
Automedon's products, services, software, and technical information may be subject to United States export control and economic sanctions laws, including the Export Administration Regulations, the International Traffic in Arms Regulations, and regulations administered by the Office of Foreign Assets Control. You agree to comply with those laws. By requesting access you represent that you are not located in, organized under the laws of, or ordinarily resident in a country or region subject to comprehensive U.S. sanctions; that you are not on, and are not owned or controlled by anyone on, a U.S. government restricted-party list; and that you will not export, re-export, or transfer any product, software, or technical information you receive from us except as authorized by U.S. law.
5. Acceptable use
You agree not to use the Site to do anything unlawful; to probe, scan, or test the Site or its hosting for vulnerabilities without our written permission (see our security.txt for how to report one); to interfere with the Site or its infrastructure; to scrape or harvest information, including email addresses, from the Site; or to submit false, misleading, or malicious content through a form.
6. Intellectual property
The Site, including its text, design, graphics, logos, and code, is owned by Automedon or its licensors and is protected by copyright, trademark, and other laws. AUTOMEDON, the Automedon mark, and TRIPWIRE are marks of Automedon Technologies LLC. Other names and marks belong to their owners and are used only to identify their products. You may view and print pages for your own evaluation of our products. Any other use requires our written permission.
7. Third-party links and content
The Site links to and embeds content from third parties, including LinkedIn, Instagram, and YouTube. We do not control those services and are not responsible for their content or practices. Their terms and privacy policies apply when you use them.
8. No warranty
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE AVAILABLE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION ON IT IS COMPLETE OR CURRENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOMEDON AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS. Some jurisdictions do not allow these exclusions or limitations, so some of them may not apply to you.
10. Indemnity
You agree to indemnify and hold Automedon harmless from any claim, loss, or expense, including reasonable attorneys' fees, arising from your violation of these Terms or of any law in connection with your use of the Site.
11. Privacy
Our Privacy Policy explains what information the Site collects and how we use it. It is part of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia and applicable federal law, without regard to conflict-of-laws principles. Any dispute relating to the Site shall be brought exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction. Nothing in this section limits either party's ability to seek injunctive relief in any court of competent jurisdiction.
13. Changes
We may change the Site or these Terms at any time. Changes take effect when posted, and the effective date at the top of this page will change. Your continued use of the Site after that date constitutes acceptance.
